South Tripoli court rejects making decision on High Council of State’s election dispute

The South Tripoli Court of First Instance ruled to reject the request submitted by three members of the High Council of State (HCS) regarding the invalidity of the session to elect the Head of the HCS and its results.

The HCS responded to the members’ request based on the participation of two members whose membership in the Council had ended, saying: “Abdelsalam Ghawela and Fawzi Al-Agab” attended the session publicly and their names were read out to the attendees and voted without anyone objecting to their participation.

The decision of the court also indicated that the participation of the two members was not objected to until after the end of the election process, which the court’s decision considered a basis for rejecting the request.

The Legal Department of the Supreme Judicial Council had informed Khalid Al-Mishri that it was not competent to adjudicate the “ballot paper” dispute in the elections for the presidency of the HCS.

The department added in its response to Al-Mishri’s request to adjudicate the dispute, that the matter requires referring it to the competent judiciary to adjudicate it, in accordance with the provisions of the internal regulations of the HCS.
